TRIDISGO PRIVACY POLICY AND TERMS OF SERVICE

Purpose of the Privacy Policy

Tridisgo provides its customers with a platform that enables them to create and manage mobile applications, as well as related support and hosting services. Through this platform, Tridisgo Customers may offer these applications to end users in connection with any events, conferences, and other activities organized by them.

Tridisgo respects the privacy rights of its Customers and End Users. Tridisgo has prepared this Privacy Policy to inform its Customers about how the personal information provided to Tridisgo by its Customers is collected, used, and processed.

This Privacy Policy provides information regarding Tridisgo’s principles and procedures concerning the collection and use of personal information obtained from:

  1. Tridisgo Customers;

  2. End Users who download and use Applications created by Tridisgo Customers; and

  3. Visitors who only browse the Application ("Visitors").

With the consent of the relevant Tridisgo Customer, End Users may be requested to provide additional personal information, and information regarding interactions between End Users and Tridisgo Customer Applications may be collected.

Before providing any information to Tridisgo Customers or other third parties, it is deemed that the Privacy Policy has been read and understood. Tridisgo assumes no responsibility for the use of End User information by its Customers.

This Privacy Policy may be updated from time to time. In the event of any changes, the updated Privacy Policy will be published on the Tridisgo website at https://www.tridisgo.app.

This Privacy Policy sets forth the privacy principles followed by Tridisgo regarding the collection, use, processing, and disclosure of personal information in accordance with the laws of the Republic of Türkiye.

Protection of Personal Data

Tridisgo acknowledges and undertakes to fulfill all obligations applicable to it under Law No. 6698 on the Protection of Personal Data ("KVKK").

Tridisgo does not collect or process "special categories of personal data" as defined under Article 6 of Law No. 6698. In addition, pursuant to Article 9 of the aforementioned Law, data is hosted on Amazon Ireland servers, where an adequate level of protection is provided. Users are requested to provide the "explicit consent" required for the installation and use of the Application and where legally required.

Finally, pursuant to Article 7 of the same Law, users may request the deletion or destruction of their personal data from the service provider at any time, and such request shall be promptly fulfilled by the Service Provider. In such circumstances, the User may no longer be able to use the Application, and you acknowledge that Tridisgo shall not be held responsible for any consequences arising from such circumstances.

The Company is responsible for Applications prepared under the responsibility of the Customer and is obliged to adequately inform its employees about the applicable legislation, including Law No. 6698 and other relevant legislation in force, as well as the measures taken in this regard.

By accepting this provision, the COMPANY acknowledges that Law No. 6698 shall be applied by Tridisgo within the scope of this Agreement; that Tridisgo shall not be held responsible for any consequences arising from the failure of the Company's employees, as Users, to provide the consent required by law for the application of the Law; and that the COMPANY has been duly informed by Tridisgo in this regard.

How the Privacy Policy Works

1. What Types of Information Do You Collect and How Do You Collect It?

 

At various times, you may be asked to provide your name, email address, telephone number, or other information. The information collected is generally categorized as either Anonymous Information or Personally Identifiable Information.

  • Anonymous Information refers to information that cannot be associated with a specific individual. Some individuals who access our Services choose not to use the personalization features applicable to them. As a result, these individuals remain anonymous to us, and the only data we may collect about them is Anonymous Information.

  • Personally Identifiable Information refers to information that identifies who you are, particularly information such as your name, email address, or telephone number. Downloading and using the Application allows the Company to identify you for the purpose of personalizing its services.

 

Use of Anonymous Information

As is the case with most applications and websites, we automatically collect certain information (such as mobile service provider, operating system, etc.) and store this information in log files.

We use this information, which does not identify individual users, to analyze trends, administer the Application, track users’ movements within the Application, and collect demographic information about our user base as a whole.

We may associate this automatically collected data with certain Personally Identifiable Information.

Persally Identifiable Information

If you are a Tridisgo Customer, when you register on our Site to create or manage an Application, you may be asked to provide personally identifiable information such as your first name, last name, company name, email address, and billing address. You may review, correct, or update your personal information by logging into your profile on our Site. If you wish to delete all of your information, we may cancel your account. We may retain an archived copy of your records as required by applicable law.

In order to use certain features of this Service or Application, Tridisgo Customers may request certain personal information from you, such as your name, company, title, email address, mailing address, and telephone or mobile phone number. Providing such information is voluntary. Depending on the Services you choose to use, your Personally Identifiable Information may be used by Tridisgo or Tridisgo Customers. Personally Identifiable Information may also be provided by agents and third parties that assist us in operating the Application.

Except as otherwise stated in this Privacy Policy, we will not rent or sell your personal information to third parties without your consent.

If you choose to allow the Application to collect your location data, such location data will be made available to Tridisgo Customers. In addition, if you have an account on Facebook, Twitter, Google+, LinkedIn, Foursquare, or other similar platforms (each a "Social Network"), your Social Network identity, including your publicly available profile photo, may be associated with your location data. Tridisgo also owns the information collected through social networks.

2. How Is Personal Information Used?

General Use

At Tridisgo, we primarily use Customers’ personal information to provide the Services and to communicate with them regarding account activity, new versions and product offerings, or other matters related to the Services.

Except for the relevant Tridisgo Customer, we do not sell or share End Users’ personal information with any third parties in any manner.

If you do not wish to receive information and news from Tridisgo, you may send an email to and request to be removed from our mailing list. In such cases, the sharing of your information with third parties is addressed in Section 4 below.

3. How Do You Protect My Personal Information?

Storage of Personal Information

Tridisgo uses secure data networks protected by industry-standard firewalls and password protection systems. Our security and privacy policies are reviewed periodically and enhanced where necessary.

Despite these measures, Tridisgo does not guarantee that its security measures will prevent unauthorized access, theft, or alteration of personal information through unlawful means.

4. Do You Share Any Personal Information with Others?

 

Service Providers

We may engage third parties to assist with the operation and distribution of our Applications, verification of users, and provision of products and services. For these purposes, we may share your Personal Information with our business partners, service providers, vendors, suppliers, Social Networks, and other third parties that provide products and services for or through this Service. These may include website or database hosting providers, verification providers, address list hosting providers, email service providers, analytics companies, distribution companies, and other similar service providers that use such information on our behalf.

Aggregation of Statistics

As a measure of the use of and interest in our Services and Applications, we may provide third parties with aggregated data regarding user behavior, based on information such as general reports, provided that such data does not identify any individual user.

Compliance with Legal Process

Tridisgo may be required to disclose personal information when requested or required by competent public authorities or applicable law.

Tridisgo Transition Period

In the event that Tridisgo is acquired by another company, enters into a partnership, or sells some or all of its assets, your Personal Information may be transferred to the new entity or structure. Any such change in ownership and any change in the control of Personal Information will be notified to you within 30 days through the Tridisgo website.

In addition, Tridisgo reserves the right, at its sole discretion, to disclose, transfer, or sell your Personal Information to its affiliated companies.

TERMS OF SERVICE

To use these Terms and the Services provided under them, you must have a mobile device that is compatible with the Mobile Service. We do not guarantee that the Application will be compatible with your Mobile Service.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use one compiled copy of each Application on an account associated with a mobile service that is owned or leased solely by you, exclusively for your personal, non-commercial use.

You may not:

(i) modify, decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code of the Application, except to the extent that such restriction is expressly prohibited by applicable law;

(ii) rent, lease, resell, sublicense, distribute, transfer, or otherwise assign the Application to any third party, or use the Application to provide timeshare, service bureau, or similar services to any third party;

(iii) make any copies of the Application;

(iv) remove, circumvent, disable, impair, damage, or otherwise interfere with any security features of the Application, or any features that restrict or prevent the copying or use of any content accessible through the Application; or

(v) remove any copyright notices or other proprietary rights notices contained in the Application.

You acknowledge that we may release upgraded versions of the Application from time to time and may electronically upgrade the version of the Application installed on your mobile device automatically. You consent to such automatic upgrades on your mobile device and agree that these Terms, and the terms and conditions applicable to the Application, shall apply to all such upgrades.

The license granted above does not constitute a sale of the Application or any copy thereof. We, our third-party licensors, or our affiliates retain all rights, title, and interest in and to the Application and all intellectual property rights relating to the Application, including any copies thereof.

You agree to comply with the laws of the Republic of Türkiye and the laws of foreign jurisdictions applicable to your use of the Service and the Application.

Standard data transmission charges may apply to your use of the Application.

B. Mobile Application from iTunes

The following also applies to any Application obtained from us or from the iTunes Store (the "iTunes Software"): You acknowledge and agree that these Terms are solely between you and us, and not between you and Apple, and that Apple is not responsible for the iTunes Software or its content.

Your use of the iTunes Software must comply with the Application Store Terms of Service. You further acknowledge that Apple has no obligation to provide any maintenance or support services for the iTunes Software.

8. Representations, Warranties, and Indemnification

You hereby represent and warrant that:

(a) you have all necessary authority, rights, and permissions to grant the licenses and provide the Materials specified in these Terms of Service;

(b) the Materials are complete, accurate, and up to date;

(c) the Materials and your use of the Service will not misappropriate or infringe any copyright, trademark, trade secret, patent, or other intellectual property rights of any third party, nor violate any other rights of any third party, including but not limited to rights of publicity, privacy, or contractual rights;

(d) the Materials and your use of the Service will not violate any applicable legislation, regulation, or law, or cause harm to any person; and

(e) your use of the Service will not violate any agreement between you and any third party.

You agree to indemnify, defend, and hold harmless Tridisgo and its officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, expenses, demands, damages, liabilities, or costs, including, without limitation, reasonable attorneys’ fees, arising out of or relating to:

(a) the Materials that you have approved for publication or provided;

(b) your use of the Service;

(c) your breach of these Terms of Service; or

(d) any actual, potential, completed, or concluded purchase, sale, transaction, or other dealings between you and any third party, or arising from or relating thereto.

9. Disclaimers and Limitations

We intend for the information provided through our Service to be accurate and reliable; however, errors may occasionally occur. From time to time, we may release updates to the Service that add, modify, or remove features from the Service. Although we make reasonable efforts to notify you in advance of an upcoming update, such updates may be automatically released with little or no notice.

The Service and all information, software, products, and related services are provided on an "as is" and "as available" basis. We and/or our affiliates, licensors, business partners, and subsidiaries disclaim all warranties, express or implied, with respect to the Service and any information, software, products, and services provided through or in connection with the Service, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Your use of our Service is at your own risk. To the fullest extent permitted by applicable law, we and/or our affiliates shall not be liable for any direct, indirect, punitive, incidental, special, consequential, or other damages arising out of or relating to your use of the Service, including damages resulting from any delay or inability to use the Service, or from any information, software, products, or services obtained through the Service, whether arising from breach of contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

Limitation of Liability

To the fullest extent permitted by applicable law, we and our affiliates shall not be liable in any way for any loss of profits or any special, incidental, or consequential damages, regardless of the cause, including damages arising from negligence.

Under no circumstances shall our liability, or that of our affiliates, licensors, or subsidiaries, to you or any third party exceed the amount of the applicable service fee paid under this Agreement.

The foregoing limitations of liability constitute essential elements of the agreement between you and us.

Errors and Delays

We shall not be liable for any errors, delays, interruptions, or other technical problems beyond our reasonable control.

 

Termination and Cancellation

You are solely responsible for canceling your account. Requests for account cancellation must be submitted in writing to . Cancellation requests submitted by telephone or to any other email address will not be considered valid.

Upon receipt of a cancellation request, all content published by you will be removed from the Service and all Applications. Such information cannot be recovered after your account has been canceled.

We reserve the right, at our sole discretion, to terminate or suspend your access to the Service without prior notice for any reason, including, but not limited to, your violation of applicable laws or the rights of another user, violation of the terms and conditions of any Service for which you have registered, or violation of these Terms of Service.

You may cancel your subscription with us at any time by submitting written notice to . You are responsible for ensuring that such notice is successfully delivered to us.

We reserve the right, at any time and with or without notice, to modify, amend, suspend, or discontinue any Service, or any part thereof, including any related feature, information, material, content, benefit, product, or service. We shall have no liability to any user or third party as a result of any such modification, amendment, suspension, or discontinuation.

 

10. General Agreement

These Terms of Service shall be governed by the laws of the Republic of Türkiye.

These Terms of Service, together with the Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and us with respect to the Service and supersede all prior written or oral representations, agreements, or understandings.

These Terms of Service may not be assigned or modified by you. We reserve the right to revise or amend these Terms of Service at any time, without limitation.

All rights not expressly granted herein are reserved by us.
